The Customer shall indemnify and hold harmless ALOHA MOBILE SCOOTERS LLC, its owners, employees, agents, and affiliates from any and all liability, loss, damage, expense (including attorney’s fees), causes of action, suits, claims, or judgments arising out of or related to injury or death of any person or damage to property of any nature whatsoever, resulting from the actual or alleged presence, use, possession, or operation of the equipment, except to the extent such injury, death, or property damage is directly and solely caused by the negligence of ALOHA MOBILE SCOOTERS LLC.

The customer understands and voluntarily assumes all risks associated with the use and operation of the equipment, including but not limited to falls, collisions, tipping, uneven surfaces, mechanical failure, weather conditions, and third party actions, whether foreseeable or unforeseeable.

ALOHA MOBILE SCOOTERS LLC is not a medical provider, does not provide medical advice, and does not determine whether the equipment is suitable for the Customer’s physical condition. All equipment is rented “AS IS” without warranties of any kind, express or implied.

ALOHA MOBILE SCOOTERS LLC retains exclusive ownership of the equipment. No sub-renting or transfer of possession is permitted. The equipment must be returned to the original pickup or delivery location, unless prior arrangements have been approved. The equipment may not be taken out of town, county, or state without written consent from ALOHA MOBILE SCOOTERS LLC.

I authorize ALOHA MOBILE SCOOTERS, LLC to charge my card in the amount of my rental, and I further authorize additional charges after rental for damages, loss, theft, late return, cleaning, or rule violations.

If the equipment is lost, stolen, or damaged, the Customer accepts full financial responsibility for the replacement or repair cost. The replacement value of a lost or stolen scooter is $1,500. Basket replacement is $35–$55 and charger replacement is $85–$150, depending on the equipment model. All charges will be applied to the customer’s card on file.

ALOHA MOBILE SCOOTERS LLC offers an optional, limited damage waiver for $5.00 per day.
Covering Accidental Damage Only.

This coverage does not cover loss, theft, misuse, negligence, or intentional damage.

I am 18 years or older and I have received instructions from the rental agent on how to operate the scooter.
I fully understand that the scooter must be off before getting in/on and off/out of the scooter.
This is a one-rider-only scooter. I am aware of the scooter’s weight capacity and I do not exceed it.
No use under the influence of drugs or alcohol.
No use on stairs, escalators, grass, sand, water or off-road use. The customer will notify immediately if the scooter breaks down. The equipment will not be abandoned and I remain responsible until the equiptment/scooter/wheelchair is returned. I will follow all local laws, hotel and property rules.

This Agreement shall be governed by the laws of the State of Nevada, with venue in Clark County, Nevada.

I UNDERSTAND AND AGREE TO ALL THE TERMS IN THIS RENTAL AGREEMENT.
